Is RS Clark & Associates a scam?
They’re legit. According to the Better Business Bureau (BBB), RS Clark & Associates (RSC) is a legitimate collection agency, founded in 1998, and the BBB opened its file on them in 2001. Listed as a billing service, RSC has indicated on its BBB profile page that it offers medical billing and collection services. Buzzfile estimates RSC’s annual revenue at $2.5 million and the size of its staff at 27 people.
According to its website, RSC has been “faithfully servicing national clients for the past 20 years and are passionate about resolving debt. RSC promises to give their full attention to…accounts, and will recover…funds as expediently as possible.”
RSC cites as its strengths several aspects of its business practices. RSC’s collection and management staff “have extensive experience with the latest analytical techniques, software and technology and their application to collections.” In addition, RSC does not charge its clients any upfront fees in an effort to ensure their clients that their staff will make a concerted effort to collect all delinquencies. RSC also claims to deliver higher the expected collection returns, especially when compared to their competitors. Finally, RSC has found that reporting delinquent items to credit reporting agencies is a valuable tool for increasing recovery rates.
RSC’s Consumers page contains links to Ask Dr. Debt; the FDCPA; the Fair Credit Reporting Act (FCRA); Equifax; Experian; and Transunion. It also indicates professional affiliation with the three major credit reporting agencies and the Association of Credit and Collection Professionals (ACA International). However, there is no information about its compliance policies or training programs.

How many complaints are there against RS Clark & Associates – RSC?
The BBB has closed 52 complaints against RSC in the past three years, with 17 closed in the past 12 months. Most of those complaints alleged problems with billing and collections. Many of the complaints against RS Clark & Associates allege problems with disseminating false or misleading information or problems with the accuracy of information reported to the credit reporting agencies. In August 2017, a complainant indicated he had made a phone payment to RSC after seeing an indication on their “Make a Payment” page that they are BBB accredited. After making the payment, the complainant referred to RSC’s BBB profile page and discovered that they are not, in fact, BBB accredited. The complainant expressed concern about what appeared to have been RSC’s effort to falsely advertise their accreditation. In response, RSC indicated that he BBB accreditation was a reference to their billing company, Billing Tree. The complainant’s response was that the “webmaster [should do] a better job of separating the entities…[because] the URL did not change to reflect that [the complainant] was leaving R S Clark’s website and entering another.”
In December 2015, a complainant indicated that RS Clark & Associates had reported to the credit reporting agencies a debt resulting from identity theft. The complainant had filed a police report, contacted the Federal Trade Commission (FTC), filed a notarized FTC affidavit of identity theft, placed a security freeze on his credit reports, and contacted the Social Security Administration. Regardless, RSC continued to report residency at an apartment at which the complainant had never lived. The complainant attempted to have the information deleted by appealing to the manager of the apartment complex, but they failed to communicate with the credit reporting agencies. After communicating directly with the credit reporting agencies, the complainant indicated that RSC continued to verify the debt despite the abundance of evidence that it was the result of identity theft. RSC did not provide a response to this complaint.

Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

RS Clark And Associates has been harassing me for about 1 year now stemming from a $200.00 bill I had with a heart specialist doctors visit I had in 2017. I went to the doctor in about Jan. 2017 for chest pain I was having and gave the receptionist my insurance card which she copied and I asked her about my co-pay for my visit which she told me would be $200.00. I told her I would pay it and the co pay that I would get for any prescription the doctor gave me but I would not be responsible for any other bills due to this visit because I did not have the money to pay for it which she informed me was OK. About 1 month later I started getting a bill for approximately $200.00 for that same visit and I called the doctors office on several occasions relating the details I just explained to you above and informed them that I was not responsible for that bill. A few months later I started getting calls and letters from RS Clark And Associates in regards to the above listed debt which I never responded to because of the agreement I had initially made with the doctors office. On Thursday 9-16-18 at approximately 11:30 RS Clark And Associates representative Patty called my workplace and told my co-worker that she was Patty with RS Clark And Associates and needed to talk to me about debt collection which I believe is a violation of my rights as I have a high security clearance for my job and this will seriously jeopardize my career and employment with my company. I did not get the number she called from as it was blocked on caller ID on my workplace phone and I also told her that I could not talk due to being at work and running a machine. She also left a message on my cell phone that same day that her name was Patty with RS Clark And Associates and to return her call at 214-50*-3132 extension 118 but I couldn’t hear the complete number as her message was garbled. They had called me many times in the past from 214-503-1482. I am now very concerned that I might lose my security clearance and my job because she is calling me at my workplace so I hope that you can help me. Thanks.

I leased a House from WestMark Leasing in Lubbock, Texas. We broke our lease because the dining room flooded from the AC backing up and leaking into the walls and floors, the PM refused to repair the walls or replace the carpets. A fan in the bedroom fell from the ceiling while it was on and I was laying in bed. The only saving grace were that the wires held it long enough for me to get out of the way. Also, the kitchen sink had major rust issues in the lines and faucet. This all after only 3 months in the House. I advised the Property Manager that we were leaving and would be out by the first.
The PM threatened legal action and threatened to send my remaining lease to collections. We worked out a deal that would allow me to pay $1000 a month until the house leased out again and I would only be liable for the lost rent in the 3 or 4 months the house wasn’t occupied.
Then he sent it to collections after the 1st three months AFTER he leased it out again, but for the FULL amount owed. Now I get calls from RSC several times a day multiple times a week. Most of the time they don’t leave a voice mail, sometimes they do.
When I asked for original documentation and an explanation of fees, RS added their fees to my debt and states that I am responsible for paying their fees.
