As of April 2017, the Better Business Bureau reported 72 closed Bay Area Credit Service complaints over the previous few decades, including 15 closed BACS complaints over the past 12 months. In 2015, a judge in U.S. District Court, Northern District of California, denied in part and granted in part a customer’s motion to amend her class action complaint in Alvarado vs. HOVG d/b/a Bay Area Credit Service for alleged violations of the Fair Debt Collection Practices Act. According to the judge’s decision, the customer wanted to bring another alleged FDCPA violation to her complaint because, when Bay Area Credit Service was deposed, it was disclosed that a debt collector mentioned that the customer said she was going to speak to her attorney. Alvarado wanted to bring the allegation that Bay Area Credit Service violated the provision of the FDCPA that prohibits calling a consumer after being advised that they’re represented by counsel.

Bay Area Credit Service claimed that the motion should be denied since Alvarado understood what she told the debt collector before she ever filed the complaint, that the change was brought in bad faith, that the one-year statute of limitations had expired, and that the new claim could alter the character of the litigation. The judge disagreed, noting that individuals do not remember every statement made during telephone conversations, and that national rules state that an amendment to a pleading relates back to the date of the original pleading. The judge granted the customer’s motion to amend the complaint, but denied a motion to add AT&T Mobility as a suspect in the case.

    I’m receiving letters and calls from Bay Area Credit Services staying I have a debt of $3500. At this moment I’m filing many disputes because I believe my identity has been stolen. Now What is it that I can do on my behalf to fix this if I don’t even know what they are talking about?

    My family members and I have received calls from this so called company that goes by the name of Bay services. I have been receiving harassing calls repeatedly and messages left on my voicemail even after I blocked their number. This guy told me his name is Mr. Swartz made threatening comments to me repeatedly like i was gonna go to jail blah blah blah if I didnt verify my personal information with him. Yet he refused to inform me of what he was calling about who the debt was with, or even how much the debt was! Yet he called and talked to my mentally ill mother and told her all my business or whatever business he thinks he has with me. My aunt also received a call from the same person which he revealed information to her also but once she found out they were some sort of fraudalant company searching for my information she also blocked their number. I have CHF, chronic high blood pressure amongst many other ailments and I do not need unnecessary stress in my life, especially being harassed on a daily basis from a unprofessional agency I know nothing about
