Can GB Collects Sue Me or Garnish My Wages?

It is illegal for a debt collector to make empty threats to sue you or garnish your wages. It is also unlikely GBC would sue you for a debt you may not owe or they cannot validate. However, debt collection agencies are known to have summoned debtors to court and garnish wages after a default judgement. Contacting an attorney BEFORE this could possibly happen would be a smart move. We’ve helped thousands of consumers fight back against unscrupulous debt collection harassers. Can you help me file a No Fee Lawsuit against GB Collects?

Absolutely. Here are some Sample Complaints

Complaints against GB Collects cite problems resulting from disputes about the validity of debts and allegations of harassment. In July 2018, a complainant stated that “approximately 1 month” earlier, he had “received a letter from GBC …indicating that they were contacting him on behalf of their client, and claimed he owed their client for a bill from a year and half” previously. The complainant stated that he had “immediately contacted them…and disputed their claim. He asked for physical proof that he owed the debt, and they couldn’t provide any.” The complainant stated that he had been insured for 2 months and paid his bills.” However, he “became unemployed…but was able to get Medicaid, so he contacted his former employer, and cancelled his insurance. At that time, no one said he owed anything.” By the time he filed the complaint, the complainant stated that GBC was calling his “phone constantly and sends him letters in the mail.” He also said GBC “failed to provide him proof, and… asked them not to be harassed anymore, but GBC continues to do so.” GBC did not provide a public response to this complaint.

In February 2019, a complainant alleged that GB Collects continued “to call him and send him letters concerning a debt” that the complainant said he does not owe. Allegedly, GBC claimed he owed payment for an insurance premium for a previous month. However, the complainant stated that he had “terminated his policy” prior to that date“and… did not have any coverage with the insurance company thereafter.” He also said that he had “sent a copy of his Form 1095-A (Health Insurance Marketplace Statement) to GBC… to prove to them that he did not owe…any money.” Regardless, the complainant stated that “even though GBC does not have any proof of… coverage with the insurance company for the month in question … they keep harassing him through phone calls and letters.” GBC stated that they “believed the complaint is the result of a misunderstanding.”

In October 2018, a complainant stated that she had “received a call… from GB Collects during which …they told her that her … husband owed a medical bill from…2017.” The complainant “told them this was not possible” because they had no coverage or treatment at the time in question. The complainant stated that the GBC representative “continued to insinuate that she owed money and was probably in trouble. She asked for the social security number the medical bill was for, but he did not have that information. She told him that he was mistaken and… felt it was a scam.” GBC allegedly “tried calling once more,” but the complainant “did not answer,” especially because she had read “one other complaint… for repeated calling to seniors about debts not owed.” GBC stated that they “believed the complaint is the result of a misunderstanding.”

GB Collects Calling You?

Federal laws protect you. The Fair Debt Collections Practices Act (FDCPA) regulates the behavior of collection agencies by prohibiting actions such as the use of abusive or threatening language; harassment; or the use of false or misleading information to collect a debt. The FCRA regulates how collection agencies and creditors report delinquent debts to credit reporting agencies. Additional consumer protection laws include the Telephone Consumer Protection Act (TCPA) and the Consumer Financial Protection Act (CFPA).

But here’s the rub: If you want to enforce your rights, or recover money for violations — you need to sue. These laws provide individuals like you with a means to seek monetary damages in court. For example, the FDCPA allows consumers who have been violated to recover damages of up to $1,000, plus attorney fees and court costs.

If this is a debt collection group I don’t know why they would be calling me. I don’t have any outstanding debts.
