Dressbarn Sending Unwanted Texts to You?

Are you receiving Dressbarn text spam? If you signed up online for a Dressbarn SMS coupon or other offers, and want to continue to receive their text messages, that’s great. But if you can’t get the texts to stop, you may be able to recover money. Our firm has received complaints that Dressbarn doesn’t honor “opt-out” requests. In other words, when consumers ask to stop receiving Dressbarn text messages, the texts keep coming.

Dressbarn sells value-oriented fashion, and in 1962 began with a single store in Stamford, Connecticut. Initially the brainchild of Roslyn Jaffe, the company is now a veritable clothing giant under the umbrella company Ascena Retail Group. Traded on the NASDAQ exchange under the stock symbol ASNA, the Dressbarn company owns Lane Bryant, Catherines, Ann Taylor, and a variety of other clothing stores. There are more than 800 dressbarn locations around the U.S.

The apparel industry is competitive, so clothing stores rely on text messaging to entice shoppers to buy – both in stores and online. Just like all other companies, though, clothing stores have to play by the rules. The federal Telephone Consumer Protection Act (TCPA) and the Federal Communications Commission regulate what businesses can and cannot do with respect to text messages.

For example, the law says that a company must have your permission to send you a text. It also forbids businesses from sending additional text messages once you’ve asked them to stop. When a company keeps texting you after you’ve told them not to, you can sue in federal court for $500 to $1,500 per text.

If you’ve been receiving unwanted Dressbarn text messages, Lemberg Law can help. Call our office at 475-277-2200 for a free case evaluation.

Dress Barn refuses to stop sending me emails. I used their unsubscribe feature on one of the emails. Still getting emails. I have sent several customer service emails. Still receiving emails. I called customer service. The rep demanded that I disclose my shipping address in order to escalate my customer service request. He then refused to give the name of the executive leadership over their customer service. The rep said his name was Jack Ward. That and nothing else will get you nonstop emails from Dress Barn.
