Is Action Collection Service a scam?

They’re legit. Action Collection Service has been in the collections business for 60 years, an extensive period of experience. Do not ignore the need to resolve your alleged debt with Action Collection Service, as this would be very unwise. In respect to the company’s timeline, Action Collection Service was started on January 1st 1961 and the company’s BBB file was opened on September 1st, 1993. The collections business has not received accreditation from the BBB. Additionally, the BBB has marked Action Collection Service with a “D-” rating, an incredibly low rating for a collections business. According to the Action Collection Service website, the company operates two different offices in Idaho and is, “committed to maintaining professionalism, respect, and integrity in all aspects of our business conduct”. Many complainants feel as though they were not treated with this professionalism and respect and disagree with Action Collection Service’s statement. Action Collection Service also claims that they are a, “Member of the American Collectors Association as well as the Idaho and Utah Collectors Associations. Fully insured, licensed and bonded in Idaho, Oregon, Washington, Montana, Alaska, and Hawaii”.

In regard to the collection company’s size, according to dnb.com the company has an employee base of 24 people and a revenue of $4.70 million. Additionally, Action Collection Service’s business has 4 different branch locations, creating the Action Collection Service family.  Lastly, dnb.com also notes that the leadership of their collections business is headed by Key Principal Brent Harris. BBB cites Manager Blair Cheney, Sale Coordinator  Dave McNamu, and Chief Finance Officer John Muir as the other parts of the company’s leadership.

Who does Action Collection Service collect for?

Action Collection Service does not specify which area of debt collection that they specialize in. Instead, the company writes that their approach to collections is individualized on a case by case basis. This means that they offer, “flexible service” for those who are in need of help with their collections issues. The specific services that Action Collection Services provides, however, include, “professional skip tracing, forwarding, correspondence response, specialized check recovery, progress reporting, dispute arbitration and resolution, credit influencing, electronic account listing, and client web access”.  With a diversified background in collections, Action Collection Service becomes a force in the collections industry. While this may be beneficial for the company, it is important that as a consumer you confirm with the collections company about what debt is specifically owed and to whom. Inquiring as soon as possible is the smartest move to make, and if you feel as though this company has breached their FDCPA rights be sure to contact an attorney to help you file a lawsuit. If you find that you have not received the same quality of service promised by this company, consider reading up on your FDCPA rights to see if there is a legal remedy to your specific problem.

How many complaints are there against Action Collection Service?

Action Collection Service has received a number of complaints across the internet, including the well established, BBB.org. Because the company has received a horrible rating from the BBB, it is no surprise that complaints have been posted about this collections company on the BBB website. Action Collection Service has received 3 complaints closed in last 3 years and two reviews on the BBB website. After researching these specific complaints, it was easy to notice that Action Collection Service dedicated zero time to responding to these complaints to at least attempt to cover their tracks. This is suspicious activity for a collections service, as most businesses that receive complaints on the BBB tend to respond to the issues and attempt to reconcile the problem at hand. On top of these negative reviews and complaints on the BBB, there were additional reviews of Action Collection Service on Google Reviews and BirdEye. Google Reviews awarded the collection company with a 1.5 star review from a total of 47 separate reviews. BirdEye also awarded the company with a 1.5 star review from a total of 52 reviews. More seriously, Action Collection Service could have also been a part of a variety of lawsuits, sanctions, and penalties. Take a look at the  Public Access to Court Electronic Records (“PACER”) which reports all federal complaints within the U.S. federal system’s docket to find out.

Can Action Collection Service Sue Me or Garnish My Wages?

It is illegal for a collections company to make empty threats to sue you or garnish your wages. Action Collection Service would most likely choose not to sue if they cannot verify your debt or you may not owe said debt. In other circumstances where this is not the case, it is not uncommon for debt collection agencies to summon debtors to court and garnish wages after a default judgement. If you find yourself in a similar situation, the wisest option would be to contact an attorney preemptively to ensure the safety of your assets and rights. Lemberg Law has helped thousands of consumers fight back against these cases of fraudulent collection practices. Call us today to find out how we can help you resolve this issue.

Can you help me file a No Fee Lawsuit against Action Collection Service?

Absolutely. You can sue a debt collector. Here is a sample complaint:

A complainant called Action Collection Service to pay a bill that the complainant had just received. The employee was allegedly rude from the very beginning of the conversation, and she demanded that the complainant be charged with a different amount than what was written on the paper the complainant had received from the collection agency. When the complainant asked why this was the case, the employee rudely answered that the company did not have to tell him/her why, but rather that the paper simply needs to state whether the charges are legal. The company also asked the complainant for their social security number, and after the complainant asked why they assured it was only to make sure the correct person was paying for the bill. It was after the complainant paid for this “upgraded amount”, that the complainant asked to speak to the manager. The manager was equally as rude as the former employee and demanded that everything the other employee said to the complainant was correct. The complainant then decided to call the bank to assure that the charges were fair and correct. Once the phone call with the collections agency was basically over the complainant asked if there was any way to avoid the excess fees and the employee said “yes, if you paid online”. The complainant was never told this information previously and feels as though they were scammed into paying excess fees. The complainant believed that they were working with the company to resolve the issue, but Action Collection Service apparently sent it to collections.
